OGUN TRIBUNAL: PDP SENATORIAL CANDIDATE HEADS TO APPEAL COURT TO CHALLENGE LEKAN MUSTAPHA

The candidate of the Peoples Democratic Party, PDP for the Senatorial position in Ogun East, Mr Adebola Sosanwo is headed to the Court of Appeal over the dismissal of his petition by Justice A.J Coker led election petition tribunal in Ogun State.

Sosanwo filed a notice of appeal at the court sitting in Ibadan, alleging that the lower tribunal erred in law when it dismissed his petition on the ground of pre-hearing notice and forms as required by paragraph 18(1) of the first schedule in the electoral Act 2010 as amended.

Speaking to our correspondent at his Sagamu residence on Monday, the PDP Senatorial candidate in the 2019, February 23rd election, accused the tribunal of failure to consider the evidence before it, which clearly shows that pre- hearing notice in form TF 007 was duly issued by the registration of the tribunal on his application.

He described the decision of the three member panel as "perverse and miscarriage of justice".

He said his decision to appeal the court decision is part of his determination to reclaim his mandate wrongly given to the APC candidate, Senator Lekan Mustapha.

According to him, among his prayers before the appellate court is to set aside the ruling of the election tribunal, remitting the petition back to the election in Abeokuta to be heard and determined by another election tribunal panel.

He said " all my wish now is an order of accelerated hearing at the tribunal in Abeokuta". Mr Sosanwo added that the tribunal also erred when it held that the petition had been abandoned even when the evidences before it showed that pre-notice and answers to pre-hearing information sheet forms TF 007 and 008 were duly issued by the registrar of the tribunal and filed by the petitioner.

He also accused the tribunal of bias and working to favour the APC candidate, Senator Lekan Mustapha saying the counsels of the candidate who are the 3rd and 4th respondents filed their answers to the pre-hearing forms.

He however appeal to his teeming supporters, party faithful and sympathizers to remain calm and undeterred as he remain resolute and unshakable in getting desirable justice sooner than expected.
